Removal Of Conditions. What You Need To Know

Once the applicant receives his/her temporary green card he should mark the expiration date in his calendar.
This is very important since 90 days before the temporary green card expiration the green card holder together with his US citizen spouse must start the removal of condition process. Keep in mind that if the temporary green card holder has been a victim of domestic violence or abuse or is divorce or his US spouse has died he can still remove the condition 90 days before the expiration of the temporary green card.
The removal of condition application and supporting documents must be done 90 days before the expiration, not before.

Currently, this process is taking close to 2 years and the USCIS can schedule a new interview.
If the receipt notice expires while the process is pending you can get a stamp in your passport by going in person to an infopass appointment.
Since the processing time is longer now it could happen that the applicant, while having the removal of condition pending, becomes eligible to apply for citizenship. If this case, apply for citizenship this could actually help to speed up the process.

Please keep in mind that every case is different and only an US licensed attorney can provide adequate legal advice.
